1. Parties
This Distance Sales Agreement is concluded electronically between LABİRENT FETHİYE İNŞAAT EMLAK TUR.SAN. VE TİC.LTD.ŞTİ. (hereinafter referred to as the “Seller”) and the customer making a reservation via the website (hereinafter referred to as the “Buyer”).
2. Subject of the Agreement
The subject of this agreement is to determine the rights and obligations of the parties regarding the villa and/or hotel accommodation service purchased electronically by the Buyer for specific dates.
3. Nature of the Service and Performance
The purchased service is an accommodation service provided on a specific date or period. The service is performed between the check-in and check-out dates specified during the reservation. The reservation becomes final once payment is completed and electronic approval is given.
4. Pre-Information and Electronic Approval
The Buyer acknowledges that prior to payment, they were informed about the essential characteristics of the service, total price, payment method, cancellation terms, and the exception to the right of withdrawal, and that they approved this agreement electronically. Electronic approval is legally binding.
5. Right of Withdrawal and Exception
Pursuant to Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, accommodation services that must be performed on a specific date or period are excluded from the right of withdrawal. Therefore, the Buyer acknowledges that if less than 30 (thirty) days remain before the accommodation date, the right of withdrawal cannot be exercised.
6. Cancellation and Refund Policy
Cancellations made up to 30 days before the check-in date are eligible for a full refund. No refund is provided for cancellations made less than 30 days before check-in. Partial refunds are not applied. Refunds are processed within 7–14 business days.
7. Price and Payment
The service fee is the total amount specified during reservation. Payments are collected via the 3D Secure security system. If the cardholder and reservation holder differ, all legal and financial responsibility belongs to the reservation holder.
8. Limitation of Liability
The Seller’s total liability shall in any case be limited to the reservation amount. The Seller shall not be liable for indirect damages, loss of profit, or damages caused by third parties.
9. Force Majeure
Natural disasters, war, pandemics, official restrictions, transportation limitations, and events beyond the parties’ control shall be considered force majeure. In such cases, the Seller may offer an alternative date or suspend the agreement.
10. Evidence Agreement
The parties agree that reservation records, IP logs, timestamps, 3D Secure verification records, and electronic correspondence shall constitute conclusive evidence under the Turkish Code of Civil Procedure.
11. Governing Law and Jurisdiction
Any disputes arising from this agreement shall be subject to the jurisdiction of Fethiye Courts and Enforcement Offices. Turkish Law shall apply.
